November 25, 2009Fort Hood Shooter-Psychiatrist To Employ Insanity Defense?I suppose I've been expecting some news along these lines concerning the accused Fort Hood shooter, an Army psychiatrist. The Wall Street Journal is now reporting: "Maj. Hasan's lawyer, John P. Galligan, separately said he was considering an insanity plea for his client. 'Based on my preliminary assessment, it's very clear that mental responsibility issues will play a very important part of the case,' he said in a telephone interview." If Maj. Hasan has mental health issues, then it might certainly bolster the case some readers have made that they suspect he was on anti-depressants and that those may be connected with his behavior. I have my doubts, but we shall see. The other thing is that if Maj. Hasan had problems, then why didn't his psychiatrist colleagues pick up on them and push for a fitness-for-duty evaluation? I predicted this would happen, (thought out loud) via the Compassion Fatigue trauma/PTSD, that could be used as a base for the insanity plea. It's why I asked in the beginning which would be on trial--the culture, the religion, the mental illness factor.... Posted by: nick at November 25, 2009 07:33 AMSince this guy is caught red handed the only defense he has is insanity. The problem with this is the problem with the entire myth of mental illness. Obviously Hasan is and was not insane, whatever that word means, as it is legally defined by whatever court will here his case. The level of his functioning and complexity of his crime clearly prove this. If Hasan is found to be insane what does this mean for others considered insane? The person who really does appear to be "schizophrenic" because of severe sexual abuse is now looked on as a little more dangerous because Hasan wins. Soldiers with "ptsd" will have their civil rights severely restricted because let's face it, dude's got to go with a ptsd defense and what about the idea that his religious beliefs are symptoms of some kind of mental illness. Well that one really might work because the only substantive difference between a state psychiatric hospital and Guantanamo Bay is in classification (oh and GB prisoners have better food and more civil rights), but do we really want to classify people as mentally ill based on their religious beliefs, uh, like the good old USSR? Of course the real reason the insanity defense is usually used is to avoid the death penalty. I'm against the death penalty and ironically if Hasan really wanted his act to be a jihad of some sort, not killing him is the worst punishment. Still, capital punishment is proof that society is insane and the only way in most places an individual can avoid it is by claiming to be insane....wonder what that's about. How absolutely inhumane to take the life of a mass muderor. What these killers really need are big hugs, some understanding, and some sanity pills; so they all will see the errors of thier ways. Punishment has really out lived its usefulness and should been deemed politically incorrect by our government and all those on the bleeding heart left. Doesn't everyone realize that the spill over could really effect these killers fragile self esteem, and cause lawsuits for personal injury in the name of "Allah" to flood our court system. So as a solutuion to all these hedious crimes committed against the innocent; let's set all the killers free, give them a cable TV pulpit to spew hate, revamp our juridical system to reflect only Sharia Law, and lets all embrace pure evil for what it is today "KING". Sounds like a rational plan for one completely insane world. Hasan is now supposedly paralized from the chest down; which should make any punsihment for his personally actions protected under the person's with disabilities act. He now needs special medical care given twenty four hours a day for the remeander of his life; not to mention the multi million dollar defence and trial coming into your living room soon. I am beaming proud to say as an American Citizen; that I and my fellow citizens will pay for every last cent of this sham and care through our well spent tax dollars. Fits rather nicely into the drum beat about Islamic extremism, and "home grown terrorists." Cui bono? Of course some would wait until tragedy actually knocked upon their personal door before getting a clue about a very real Radical Islamic Threat to our way of life and to the security of this nation.
