Citing "Excessive Claims," Federal Judge Presses Lilly To Settle All Zyprexa Cases

Of course this comes out right ahead of the holiday: US District Court Judge Jack Weinstein, who's been overseeing various class action lawsuits against Lilly over Zyprexa, today urged Lilly to settle all outstanding cases against it...worldwide. The company has already settled about $1.3 billion worth of cases.

"In a draft order filed today in federal court in Brooklyn, N.Y., Weinstein said he found 'reliable information' that Lilly made excessive claims about Zyprexa's usefulness, and recommended off-label uses for such conditions as panic and anxiety disorder, agitation and dementia, Bloomberg said. Zyprexa is approved for schizophrenia and bipolar disorder.

"'A global settlement for the overpricing claims and any other claims is desirable,' Judge Weinstein wrote, according to Bloomberg. He added that plaintiffs are seeking between $4 billion and $7.7. billion in damages, or about 25 percent of the amount they spent on Zyprexa since 1996."

Reportedly, Lilly is reviewing the order and a July 17 hearing is set for Weinstein's court. Whatever settlement is reached will likely be the largest ever.

Cheap shot alert: I hope the CIA didn't pay for that LSD - because if it did, I'm sure the Agency will be wanting their money back off Eli, seeing as the fucking drug didn't have the desired effect.

"There was undoubtedly off-label use of all drugs in this area. Doctors can use drugs for whatever they want to,” said Michael Harrington, Lilly’s general counsel. “But we deny we promoted the drug improperly for off-label uses."

The fact that this company is in constant defense regarding the truth behind Zyprexa completely disgusts me.

This is an industry, and Lilly is a company that has not taken an oath to protect human life: but the company is ran by human beings, who in my opinion have no concern over human life.Period. The fact that the company fights each battle to the death regarding Zyprexa is astounding.

Do the ZYprexa documents not say enough?

Of course Lilly will deny direct to doctor influence via mailings or drug reps, etc because that is their job. They want their company on top, and the people in the end suffer--patients, adults and children.

In the time frame listed in the article (2001-2005) my daughter's Zyprexa taken every singe day cost $17,000.00.

What would the insurance company think now? I paid a 20-40.00 co-pay during those years before her insurance ran out--so the insurance company should have a vested interest in any case that comes up regarding Zyprexa, because it was after all prescribed to my daughter at an age that was not approved for use in children and for a misdiagnoses to boot.(and once her private insurance ran out Medicaid picked up the tab!)

A pill that was so important, @ 12 -15 bucks a pill--did NOTHING for my daughter, except cause agitation, aggression, psychosis and over 100 pound weight gain. That was just her experience, it might have helped or is helping others. This is not my opinion about a persons choice to take meds.

It's a public safety issue here, based on lies and withheld truth by Lilly.(again my opinion.)

I would only like to know why Zyprexa is being used to treat cocaine addiction.
Prozac to treat alcoholism and many other psychiatric drugs are "helping" people rehab.

Good! Change a drug to another. Just change the dealer.
And now people who are addicted to street drugs are being called bipolar by the psychiatrists and the family. I guess it's better to be called bipolar than drug addicted. Charming!
It also gives the psychiatric immunity in case a person commits any act under street drugs that can lead to prison.
I'm raising this issue because it has many implications.
Jesus! It's hard!

To explain my last comment:
I left a person who claimed suffers "bipolarity" come to my house.
While I was in the bathroom this person opened my purse and stole my wallet with all the money.
I've found out that this person is drug addicted and is being treated on a mental institution under the "diagnose" of bipolarity.
Never met a bipolar who do such things.
What on earth bipolarity means?
People who are addicted to drugs are not bipolar but psychiatry is using this diagnose and mixing it all.
The worse is that people who are really bipolar and has to fight the stigma now has another reason not to be trusted: they steal, lie or commit other crimes.
It's unfair and totally beyond comprehension.
Thanks psychiatry for making all this mess!

This person takes Zyprexa. So we think it's really bipolarity. But you find out that pharmaceutical drugs are being used to "treat" addiction.
People keep on having street-drugs and also pharmaceutical drugs.
Good! Good treatment to a ticket to paradise!

PS: I'm not claiming that all people who take street-drugs are criminals.
No!
There are many people who suffers a lot under these drugs. But some are people who can make evil things.
Psychiatry will protect these people?
It's a complex issue.

Jesus!
This person live in my building. Today I went to walk by the sea to try to relax and I met this fella.
He looked at me as if I was the one who did him evil!
Great! I had to take security measures in my building for i don't know who this person is connected to for he told me that one of the things he did with the money was "paying his cocaine dealer"!
Great!
Them mental institution where he's being treated, as a bipolar, is in front of my house, yep, I live in front of 2 mental hospitals, and it's public and is a center of excellence on brazilian's mental care.
The thing is that there has been robbery from people who are from this hospital on my street.
People are pissed of with mental patients:o)from this institution.
No patient from the other ever got out to steal from people around the street.
They are not mental patients for god sake!
They are addicted to drugs and same of them steal to take streets-drugs while receive Zyprexa and others expensive medications from the hospital.
There's a band of musicians from this institution and he is actually playing guitar for them.
One of the members has committed suicide.
I'm not understanding anything.
This is not what I understand about mental illness, bipolarity and, of course, psychiatry.

My take on Zyprexa, Paxil and all the other new drugs which come out and are marketed to death while the drug companies suppress side effects for years is..

When you think about it, the profit they make on these drugs is obscene and taking into account litigation on the life time of the drug, it hardly even makes a dent in their profits in the long run..

So do they give a f*ck?..

One of the more boneheaded mistakes of my field was to include addiction as a psychiatric diagnoisis, so now addicts literally get dumped onto psych units to be treated, and since most insurance companies seem to think that addiction is not a mental illness and not reimburse for it as the primary diagnosis, psychiatrists have to give a major psychiatric diagnosis for the hospital to be paid. And, since most addicts are all over the place with mood and thinking in intoxication or withdrawal, what is the most convenient diagnosis: Bipolar Disorder! And (wait, there is one more) what do most psychiatrists these days do with bipolar diagnoses, give the patient not one, not two, but usually three or more meds, all while in the hospital for the 4 to 7 days the patient usually stays beore dumped back on the street.

I'm waiting for DSM V to include neurological illnesses as psychiatric ones, just so the book is even bigger and more inclusive with the specialty it shares as its Board Certification status (the American Board of Psychiatry & Neurology, for those not aware).

Another mistake was to include dementia as a primary psychiatric diagnosis. These patients become our responsibility most often now too, and our cluelessness to use antipsychotics like pez with them is coming back to bite us in the ass, as you have read here and other places.

Not that these two areas of illness do not have psychiatric aspects to them, they are just not primary psychiatric illnesses. But, make subspecialties like addiction and geriatric psychiatry, and these boneheads have to find ways to make their money.

Sheesh!!!

A tip for those interested: once you identify someone as an active addict not showing any effort or interest in recovery, do not trust them. Addiction is terminal selfishness until the addict has accepted there is a problem and it needs treatment.

Noted by one who worked in an addiction rehab program for over three years. They need help, not for us to be their victims.

cut to the chase: the DSM V is a waste of time, effort and most of all:

code # to gain services, per doctors "orders".

The DSM V should be: and will be: and I hope to be: taken to court; for every single dx created as a result.

There once was a time when book burning was favorable and detested all at once.

This is the book that needs to be shredded; it is only saving the pharmaceutical industry.

A tip for those interested: once you identify someone as an active addict not showing any effort or interest in recovery, do not trust them. Addiction is terminal selfishness until the addict has accepted there is a problem and it needs treatment.

Thanks for your remarks. You said everything I'm thinking about this problem.
He does not accept there's a problem even though he is "treating" himself.
But he still using alcohol, cocaine, pot and all the drugs the institution is giving him for free.
He said that Zyprexa helps to make him "functioning".
It's helping him functioning to have more and more street-drugs. Her mother said he does not accept his problem.

A friend of mine took zyprexa for psychotic features. The psychiatrist gave it to her the same day zyprexa rep. came into his office. At first , the doctor didn't write out a prescription, he just gave it to her out of his office. When she switched doctors, the new doctor gave it to her in a prescription, so there's only 2 on file. She started taking zyprexa in 1997, just got off of it in August 2005.Diagnosed with diabetes Dec.2005.The doctor in the state she's in now says in a sarcastic way "SHE DIDN'T GET DIABETES FROM ZYPREXA",I think Eli Lilly is protecting the doctors and paid them to prescribe that deadfull drug. Eli Lilly need to take responsibilty for what they did and settle all the claims against the drug. To make matters worse, they also put my friend on another drug made by that company called "CYMBALTA" in which it gave her a nerve infection. The pharmacutical companies are out for money and not give a damn about what they're doing to the consumers. The FDA don't care either. They all just want to get rich at any cost.
