Starbucks Pays For Discrimination Against A Bipolar Barista

$75,000 to be exact. To a Seattle barista the Seattle-based McCoffee chain discriminated against--including a manager berating the barista in front of customers. All over depression and bipolar disorder. Glad to see another win for our side. Maybe between this and cases like the bipolar cop's, things will actually change. But I doubt it. I've been in the game too long for me to see America changing at anything other than glacial speed. Congratulations to Christine Drake for having the guts to go to the EEOC in the first place and to the EEOC, which doesn't push enough of these cases, for pushing on this one. Where were you in 1994?

An account from the Seattle Post-Intelligencer last year summarizes what went on:

"The EEOC said Drake, now 34, began working at Starbucks in September 2001, and for two years had two different managers who accommodated her by giving her additional time to study to make drinks. They also would let her practice making drinks in the Queen Anne store, and she didn't have to make coffee during peak business hours.

However, when a new manager took over in August 2003, that person -- who is not identified in the suit -- no longer provided those accommodations, the EEOC said. Drake said she was told by that manager that she was "not Starbucks material" before she was fired in May 2004."

Yesterday, I took a survey on employment issues around mental illness that the State of Washington is conducting. The questions were open-ended and I unloaded about how bad I think things still are out there. (Via Starbucks Gossip.)

This is wonderful. i wish i had the balls to do this to my old boss when he would do this to me in front of the whole dept. i wonder if this is retroactive.

In defense of Starbucks (yikes, am I actually saying that) when I worked for a social service agency in which all our clients were schizophrenic, Starbucks was one of the only employers we could regularly count on hiring our people. They gave them 20 hr part time jobs with full benefits...Some of these clients were visibly impaired by their mental health...one of whom constantly mumbled back to her voices...she was never let go and was appreciated for her hard work.

We may be dealing with an asshole manager and not a system wide problem.

Not "Starbucks material"? Bummer. She's going to carry that weight for the rest of her life.

Everytime I've read about this story, it seems to me that the issue has been around the manager, but where I get stuck is why Starbucks HR didn't resolve the issue if they are so open to working with psych dxs. Just seems odd.

The in house manager is the problem or the solution. I know of a Starbucks that has special education students working there just fine. Kind, considerate employers do answer to corporate bosses though, so yes the higher ups need to require the managers to take classes regarding communicating with employees effectively and with dignity no matter who they are. Starbucks has has other harrassment suits, etc. they are not a squeaky clean organization. The CEO is local, and he sold out like the newspapers have to world wide sales and less hometown interest or ties, leaving a large heartless corporation making a lot of money and loss of character in the company resulted.

Thank you for all of the well wishes. Someone mentioned the HR and the managers part in this situation. I contacted the HR on the manager several times to allert them to what was happening. I was more than happy to have someone come and visually watch what was happening and happened for eight months. Under this manager when he had put me on probation I was constantly asking him what was needed to be done to save my job. He was never clear about it. Telling me that I didn't belong there and If I didn't like it than leave. Also That. why should I worry I am on disability. The last meeting we had when he fired me I will unfortunetly always remember.. he said I am putting you on another month of probation. I looked at him teary eyed and said that I didn't know how much more of his treatment I could take and why was he so unwilling to work with me..why are you ignoring me. That was when he wrote across the paper your terminated. At least he is no longer a manager. after I first filed with the EEOC he was asked to step down from his management position ?? Interesting huh?
